Interpretation and Definitions

1.1. In this Policy, unless the context otherwise requires, the following terms shall have the meanings set out below, whether used in the singular or the plural.
1.2. “Company”, “We”, “Us” or “Our” means CIG Media & Analytics, a company incorporated under the laws of India with its registered office at 86 DD Mondal Ghat Road, Dakshineshwar, Kolkata.
1.3. “Website” or “Service” means the online platform accessible at mobanerd.com.
1.4. “Digital Products” or “Goods” means (i) tournament registrations and (ii) virtual game-currency credits purchased via the Website.
1.5. “Order” means Your electronic request to purchase one or more Digital Products.
1.6. “You” or “Your” means the individual or legal entity placing an Order.

Cancellation of Tournament Registrations

2.1. You may request cancellation of a Tournament Registration Order up to six (6) hours after the time of payment. All cancellation requests must be submitted in writing to editorial@mobanerd.com and must include Your Order ID, tournament name, team name, and the date and time of payment.
2.2. Cancellation requests received within two (2) hours of payment shall be eligible for a full refund of the entry fee.
2.3. Cancellation requests received between two (2) hours and five (5) hours after payment shall incur a cancellation fee equal to twenty percent (20 %) of the entry fee for each elapsed hour or part thereof. For example, a request at 4.2 hours post-payment will incur a forty percent (80 %) fee.
2.4. Cancellation requests received after five (5) hours from the time of payment shall be deemed forfeited and are not eligible for any refund. All determinations of elapsed time shall be made at Our sole discretion, based on timestamp records.
2.5. All refunds under this Section 2 are subject to verification of payment details and identity, and may take up to fourteen (14) days to process.

Virtual Game Currencies

3.1. All purchases of virtual game-currency credits are final once the credits have been delivered to Your designated in-game or wallet account.
3.2. Notwithstanding Section 3.1, in the event of demonstrable technical delivery failure (for example, system error preventing credit allocation), You may submit a written refund request to editorial@mobanerd.com within two (2) hours of attempted delivery. Such requests will be evaluated and granted at Our sole discretion.

4. Capacity-Related and Out-of-Stock Refunds

4.1. In the event You submit payment for a Tournament Registration but Our system indicates that the tournament slots are fully booked prior to confirmation of Your entry, You shall be entitled to a full refund of the entry fee, irrespective of the timing or any cancellation-fee provisions set out above.

Refund Procedure

5.1. Upon approval of a cancellation or refund request under this Policy, We will issue a refund to the original payment method used for the Order.
5.2. Refunds will be initiated within fourteen (14) days of Our written approval and may take additional time to appear in Your account, depending on Your payment provider’s policies.
5.3. We will notify You by email once Your refund has been processed.

Notice Requirements

6.1. Any notice, request or other communication required or permitted under this Policy shall be in writing and delivered by email to editorial@mobanerd.com.
6.2. A notice shall be deemed given on the date of confirmed email transmission, provided that no automated bounce-back or error message is returned.

Miscellaneous

7.1. No waiver by Us of any breach or default under this Policy shall be deemed a waiver of any subsequent or other breach.
7.2. If any provision of this Policy is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7.3. We reserve the right to assign or transfer Our rights and obligations under this Policy to any affiliate or successor entity without notice to You.
7.4. This Policy, together with any documents expressly incorporated by reference, constitutes the entire agreement between You and Us concerning cancellations and refunds of Digital Products.

Governing Law and Jurisdiction

8.1. This Policy shall be governed by and construed in accordance with the laws of India.
8.2. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
